Job Summary: The Certified Mediator will facilitate the resolution of disputes between parties by guiding discussions, promoting understanding, and assisting parties in reaching mutually agreeable solutions. This role requires strong interpersonal skills, neutrality, and the ability to manage conflicts constructively.

Key Responsibilities:

  • Conduct mediation sessions to help parties resolve disputes effectively.
  • Facilitate open and respectful communication between disputing parties.
  • Assist parties in understanding and clarifying their issues, needs, and interests.
  • Help parties generate and evaluate options for resolution.
  • Draft settlement agreements and ensure they are clear and enforceable.
  • Maintain neutrality and confidentiality throughout the mediation process.
  • Prepare and maintain detailed records of mediation sessions.
  • Provide post-mediation follow-up as necessary.
  • Stay updated with relevant laws, regulations, and best practices in mediation.
  • Participate in professional development and training programs.
  • Collaborate with legal professionals, counselors, and other relevant parties as required.

Job Roles:

1. Case Management:

  • Assess the suitability of cases for mediation.
  • Schedule mediation sessions and manage the logistics of the mediation process.
  • Handle administrative tasks related to case management, including documentation and reporting.

2. Mediation Facilitation:

  • Conduct pre-mediation interviews to gather information and prepare parties.
  • Guide the mediation process, ensuring that it progresses in an orderly and constructive manner.
  • Use various mediation techniques to assist parties in resolving their disputes.

3. Conflict Resolution:

  • Analyze the root causes of conflicts and work with parties to address these issues.
  • Help parties develop creative and practical solutions to their disputes.
  • Encourage and foster a collaborative approach to problem-solving.

4. Communication and Advocacy:

  • Ensure that all parties have a chance to voice their concerns and perspectives.
  • Promote understanding and empathy between disputing parties.
  • Advocate for fair and equitable solutions that meet the interests of all parties involved.

5. Documentation and Reporting:

  • Draft and review mediation agreements to ensure they are comprehensive and enforceable.
  • Maintain accurate and detailed records of mediation sessions, agreements, and follow-up actions.
  • Provide reports and updates to management and other stakeholders as required.

6. Professional Development:

  • Participate in ongoing training and professional development to stay current with best practices and legal requirements in mediation.
  • Network with other mediators and professionals in the field to share knowledge and experiences.

Qualifications:

  • Certification as a Mediator from a recognized institution.
  • Bachelor’s degree in law, psychology, social work, or a related field (Master’s degree preferred).
  • Minimum of 2 years of experience in mediation or a related field.
  • Strong understanding of mediation principles, techniques, and best practices.
  • Excellent communication, negotiation, and interpersonal skills.
  • Ability to remain neutral and unbiased.
