Conciliation
Conciliation involves an ADR process in which a conciliator assists parties in settling disputes by proposing potential solutions to the substantive issues. If parties opt for conciliation, the conciliator guides the process and suggests a settlement, which is then discussed, negotiated, and refined with the parties. Ultimately, the settlement is consensual and subject to agreement by the parties. Like mediation, the conciliator remains neutral and impartial, without the authority to impose a resolution.
Furthermore, the conciliator serves as a rapporteur or examiner during dispute resolution sessions. Parties opting for conciliation will not recognise the conciliator’s role in any future decision-making activities concerning the dispute.
