MED-ARB
In Med-Arb sessions, disputing parties voluntarily pursue resolution under the guidance of mediators, with the flexibility to appoint the mediator as an arbitrator if required to break the deadlock. This transition occurs when parties, despite encountering an impasse, seek a resolution and authourise the mediator to assume the role of arbitrator. Parties engaging in Med-Arb agree not to challenge the mediator’s participation in subsequent decision-making processes regarding the dispute.
MED-CON
Similarly, in Med-Con sessions, parties voluntarily endeavor to resolve their dispute with the aid of mediators, with the option to appoint the mediator as a conciliator if necessary. This shift occurs when parties face an impasse but still pursue a resolution, granting the mediator the authority to act as a conciliator. Parties selecting Med-Con also consent not to dispute the mediator’s involvement in future decision-making activities regarding the dispute.
