These Terms and Conditions (“Terms”) govern your use of the services provided by the Arbitration and Mediation Justice Centre Ltd, otherwise known as ADR Justice Centre (“the Centre”). By accessing or using the Centre’s services, you agree to be bound by these Terms. If you do not agree with these Terms, please refrain from using our services.
- Scope of Services: The Centre provides alternative dispute resolution (ADR) services, including arbitration, mediation, negotiation, and conciliation, to assist parties in resolving disputes outside of traditional litigation.
- Appointment of ADR Practitioners: The Centre may appoint qualified arbitrators, mediators, or other ADR practitioners to facilitate dispute resolution proceedings. The selection of practitioners will be based on the nature of the dispute and the preferences of the parties involved.
- Confidentiality: All communications, documents, and information shared during ADR proceedings are confidential and shall not be disclosed to third parties without the consent of the parties or unless it is as required by law.
- Neutrality and Impartiality: ADR practitioners affiliated with the ADR Justice Centre shall act with neutrality and impartiality, refraining from favouring any party involved in the dispute. They shall disclose any conflicts of interest that may affect their ability to serve impartially.
- Fees and Expenses: The parties involved in ADR proceedings shall be responsible for the payment of fees and expenses associated with the services provided by the Centre and its practitioners. Fee schedules and payment terms will be communicated to the parties prior to the commencement of proceedings. Our fees are displayed on our website and are subject to review, as it may be necessary. Parties are to inquire if the fees have not changed at every occasion of their visit or request for our service.
- Conduct of Proceedings: ADR proceedings conducted by the Centre shall adhere to principles of fairness, transparency, and procedural integrity. The parties involved shall cooperate in good faith and comply with any procedural rules or guidelines established by the Centre.
- Enforcement of Awards and Settlements: Any awards or settlements reached through ADR proceedings facilitated by the Centre might be binding and enforceable in accordance with applicable laws and regulations, depending on the parties’ unanimous agreement. Generally, Arbitration and Adjudication are binding and enforceable.
- Limitation of Liability: The Centre and its practitioners shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of its services, except to the extent prohibited by law.
- Governing Law and Jurisdiction: These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. Any legal actions or proceedings relating to these Terms shall be brought exclusively in the courts of England, provided it is unresolvable by ADR services after 12 months.
- Amendments to Terms: The Centre reserves the right to modify or amend these Terms at any time without prior notice. Any changes to these Terms will be effective immediately upon posting on the Centre’s website.
